Hi all,

We are faced with a situation where outside individuals (those not affiliated with our HOA on any way) sneak in and try to use our amenities. Sheriffs office will not intervene as they say it’s not a matter for them – so, how do each of you handle this? What do you to keep non-members out? What happens if someone who not a member is caught using your amenities?

I believe the Sheriff Department representative that provided that information is incorrect. These people are trespassing on private property and there should be no problem with you filing trespassing charges with the Sheriff. We (POAs) are all subject to BC Codes. If a resident in our community violates one of those Codes (noise, trash, burning, etc.) they can be reported for those violations. The Sheriff is the organization the violation will be reported to. Just because we choose to live in a private community, we do not give up our rights as residents of the county and law enforcement is one of those services we all pay for.

All of our amenities at Winding River Plantation are gated or have access control mechanisms which greatly reduces access by non-members.  We utilize appropriate signage indicated access is restricted to members and guests. In the rare instances that we have had trespassers; we have not had any issues in asking them to leave and having police come provide support.
